Knowing Your Responsibilities as a Landlord

There are a number of obligations which a landlord must meet when letting a property. Here are the most important to consider for rentals in England.

Meeting Safety Standards

You must have an annual Gas Safety Check carried out by a Gas Safe Registered Engineer and ensure any necessary work identified is carried out. This is a legal requirement. Tyrer & Hart can arrange this for you and will keep track of when the tests are due.

Any furniture left in the property must meet fire safety standards.

Landlords must ensure any electrical equipment provided is safe. Tyrer & Hart can arrange an NICEIC Electrical Safety Inspection on the property and any Portable Appliance Testing (PAT) which might be required.

The fitting of carbon monoxide detectors is recommended though not a legal requirement.

Landlords of HMOs have extra legal obligations to provide extra fire precautions and means of escape.

Allowing tenants ‘quiet enjoyment of the property’

You may need to gain access to your property to inspect it and do repairs. It is important to remember however that tenants have the right to live in the property without unnecessary interference, and ideally you should give tenants 48hrs notice if you wish to gain access to the property.

Ensure repairs are carried out within a reasonable timescale and that the property remains fir for habitation.

The Landlord and Tenant Act 1985 means that it is illegal for your property to be left in an unhealthy state.

Landlords are responsible for most repairs to the exterior or structure of a property. This means that problems with the roof, chimneys, walls, guttering and drains are the responsibility of the landlord. Landlords are also responsible for keeping the equipment for supplying water, gas and electricity in safe working order.

Tenants often have responsibility for some minor repairs and maintenance. This usually relates to the internal decoration and maintaining the garden for example.

Protecting Deposits

Landlords must pay any deposits taken into a Government approved deposit protection scheme, and any disputes can be resolved through their independent arbitration service.

All deposits taken by Tyrer & Hart are held with the Deposit Protection Service ensuring that all deposit matters are dealt with in a fast, fair and secure manner, and protected in line with current legislation.

Follow the correct procedure to evict a tenant

It is illegal to evict a tenant without due notice. In most cases written notice must be given and then a court order obtained to evict a tenant. If a landlord tries to force a tenant to leave without following the correct procedure they may be carrying out an illegal eviction. Similarly, landlords are not allowed to harass their tenants (for example, by coming round too often or at unsuitable times). Both of these are serious criminal offences, which can lead to fines or imprisonment.

Having an up to date Energy Performance Certificate (EPC)

An EPC is now a legal requirement to sell or let a property.

Follow the rules on rent

Rent can be increased but only at certain times during the tenancy and in certain circumstances depending on the type of tenancy and particulars of the agreement.

If rent is paid weekly then rent books have to be provided.
